Terms & Conditions
svatebnikamery.cz
Valid and effective from 1 September 2026
1. Introductory Provisions
1.1. These terms and conditions (hereinafter the "Terms") govern the mutual rights and obligations between the operator of the svatebnikamery.cz service, BHE pictures s.r.o., Company ID (IČO): 14173751, with its registered office at Vitošská 3410/1, Praha 4, 143 00 (hereinafter the "Provider"), and the customer (hereinafter the "Customer"), arising in connection with the provision of the services described in Article 2 of these Terms.
1.2. Provider's contact details: e-mail hello@svatebnikamery.cz, website https://svatebnikamery.cz.
1.3. A Customer is any natural or legal person who orders the Service from the Provider. If the Customer is a consumer within the meaning of Section 419 of Act No. 89/2012 Coll., the Civil Code (hereinafter the "Civil Code"), the consumer protection provisions shall also apply to the contractual relationship.
1.4. Legal relations not governed by these Terms are governed by the laws of the Czech Republic, in particular the Civil Code and Act No. 634/1992 Coll., on Consumer Protection.
2. Description of the Service
2.1. The Provider provides the Customer with:
a) the rental of video cameras (handycams) and accessories for the wedding day, in the Small (1 camera), Medium (3 cameras) and Large (5 cameras) packages, in the HD or 4K category (hereinafter the "Equipment");
b) the processing and delivery of the recorded footage — download of the raw (RAW) footage via the Frame.io platform within 72 hours of the return of the Equipment;
c) optionally, for an additional fee, editing services (edited film of 10 min or 5 min, 1-min highlight, reformatting for social media) and transport of the Equipment pursuant to Article 6
(together hereinafter the "Service").
2.2. The rental period of the Equipment runs from 6:00 p.m. on the day preceding the wedding day until 9:00 a.m. on the day following the wedding day, unless the parties agree otherwise (hereinafter the "Rental Period").
2.3. The stated recording capacity (approx. 3 hours per camera) is indicative and corresponds to the capacity of the batteries and storage media under normal use. The Provider does not guarantee any specific length or content of the footage, as the footage is recorded by the Customer and their guests.
3. Order and Conclusion of the Contract
3.1. The Customer makes a reservation via the reservation form on the website, in which they select the wedding date, package, camera category and method of delivery, and fill in their contact details.
3.2. Submitting the reservation form does not constitute a binding order; it is a request. Based on the request, the Provider will send the Customer a draft contract for the provision of the Service by e-mail.
3.3. The contract is concluded upon its signature by both parties (electronically or in writing). After the contract is signed, the Provider will send the Customer a proforma invoice for the reservation fee. The date is bindingly reserved at the moment the reservation fee is credited to the Provider's account.
3.4. If the Customer fails to pay the reservation fee by the due date stated on the proforma invoice, the reservation of the date lapses and the Provider is entitled to offer the date to other interested parties.
3.5. The contract is concluded in the Czech language. The Provider archives the contract in electronic form and will make it available to the Customer upon request.
4. Price and Payment Terms
4.1. The prices of the packages and additional services are listed on the svatebnikamery.cz website and are fixed; the prices effective at the time the reservation is submitted apply. The Provider is a VAT payer; prices are inclusive of VAT.
4.2. The price of the Service (or the remaining part thereof after deduction of the reservation fee) is payable in advance, no later than [TO BE COMPLETED: e.g. 14 days] before the wedding date, by payment card or bank transfer in accordance with the Provider's instructions.
4.3. The Customer acknowledges and agrees that their payment card will be pre-authorised (a hold placed on it) as security in the event of loss, damage or late return of the Equipment, up to the amount of the damage fee pursuant to Article 8.4. The authorisation hold is released without undue delay after the proper return and inspection of the Equipment, unless it is drawn upon pursuant to Article 8.
4.4. Requests beyond the scope of the package (e.g. a longer Rental Period, additional editing revisions, non-standard logistics) are handled individually by the parties; such performance is invoiced by the Provider separately at a price agreed in advance.
5. Handover and Return of the Equipment
5.1. The Equipment is handed over in person in Prague (free of charge) or delivered by courier pursuant to Article 6.
5.2. Upon receipt, the Customer is obliged to inspect the Equipment and to report any apparent defects or missing items to the Provider without undue delay, no later than 60 minutes after receipt. Apparent defects reported later will not be taken into account.
5.3. The Customer is obliged to return the Equipment complete, including all accessories and storage media containing the footage, no later than by the end of the Rental Period, in the manner agreed in the contract (in person in Prague or by handover to the collection courier).
5.4. In the event of a delay in returning the Equipment, the Provider is entitled to charge a contractual penalty of CZK 2,000 for each commenced day of delay for each camera; this is without prejudice to any claim for damages.
6. Transport
6.1. Personal pick-up and return in Prague is free of charge at the address communicated by the Provider.
6.2. Delivery and collection by courier is available throughout the Czech Republic and the Slovak Republic; the transport price is determined by the distance from Prague and is communicated to the Customer before the conclusion of the contract.
6.3. In the case of courier delivery, responsibility for the Equipment passes to the Customer at the moment of receipt of the shipment; in the case of courier collection, it ends at the moment the shipment is handed over to the courier, provided that the Customer proves that the Equipment was properly packed in its original transport packaging.
7. Use of the Equipment
7.1. The Customer is entitled to use the Equipment exclusively for recording the wedding event for which it was rented. The Customer may entrust the Equipment to their wedding guests; the Customer is liable for their handling of the Equipment as if using it themselves.
7.2. The Customer is not entitled to hand the Equipment over to a third party for any other purpose, to rent it out, to interfere with it, to remove the Provider's markings, or to delete or modify the factory settings.
7.3. The Customer is obliged to protect the Equipment against loss, theft, damage, moisture, falls and extreme temperatures. The Equipment is not waterproof unless expressly stated otherwise.
8. Liability for the Equipment, Damage Fee
8.1. The Customer assumes responsibility for the rented Equipment for the entire Rental Period, from receipt until its proper return.
8.2. The Customer is liable for the loss, theft, destruction or damage of the Equipment or any part thereof, regardless of fault, with the exception of normal wear and tear corresponding to proper use.
8.3. The Customer is obliged to notify the Provider of any loss, theft or damage without undue delay, at the latest upon return of the Equipment.
8.4. The Provider charges compensation for damage in the actual amount (cost of repair or the purchase price of comparable equipment), up to a maximum of CZK 20,000 per camera including accessories (hereinafter the "damage fee"). The Provider is entitled to draw the damage fee from the payment card authorisation hold pursuant to Article 4.3; if the damage exceeds the authorised amount within the stated limit, the Customer shall pay the difference on the basis of an invoice.
8.5. The Provider shall document the damage assessment to the Customer (photo documentation, price calculation of the repair or replacement).
9. Footage, Its Delivery and Editing
9.1. The Provider will make the RAW footage from all cameras available to the Customer for download via the Frame.io platform within 72 hours of the proper return of the complete Equipment, including the storage media.
9.2. The download link is active for 14 days. The Customer is obliged to download the footage within this period; after its expiry, the Provider is entitled to delete the footage. The Provider recommends that the Customer make their own backup.
9.3. If the Customer orders paid editing, the Provider will deliver the edited output within 2 weeks of the RAW footage being made available, or of the delivery of materials and the brief by the Customer, whichever occurs later. The editing price includes one revision round; additional revisions are charged according to the price list or individual agreement.
9.4. Copyright and personality rights: the footage is recorded by the Customer and their guests. The Customer is responsible for ensuring that the persons captured in the footage were informed of the recording, and for settling their personality rights. The Provider uses the footage exclusively for the purpose of its processing and delivery to the Customer; any other use (e.g. promotion of the Provider) requires the Customer's prior express consent.
9.5. The Provider is not liable for the quality or content of the footage recorded by the Customer and their guests (shaky shots, poor composition, unsuitable lighting conditions, unrecorded moments, etc.), nor for the loss of footage caused by the Customer's or guests' interference with the Equipment or storage media.
10. Cancellation of the Reservation, Withdrawal from the Contract
10.1. Cancellation by the Customer: The Customer may terminate the contract (cancel the reservation) at any time before the start of the Rental Period in writing or by e-mail, under the following conditions:
- cancellation more than 30 days before the date — all payments made will be refunded with the exception of the reservation fee;
- cancellation 30–15 days before the date — a cancellation fee of 50% of the price of the Service;
- cancellation less than 15 days before the date — a cancellation fee of 100% of the price of the Service.
10.2. Consumer information on withdrawal: A Customer who is a consumer has the right, when a contract is concluded by means of distance communication, to withdraw from the contract without giving any reason within 14 days of its conclusion (Section 1829 of the Civil Code). However, the Customer acknowledges that pursuant to Section 1837(j) of the Civil Code, it is not possible to withdraw from a contract for the use of leisure time if the performance is to be provided on a specified date — which is the case for the rental of the Equipment for a specific wedding day. The right of withdrawal under this paragraph therefore does not apply to the reservation of a date; this is without prejudice to the cancellation rules under Article 10.1. [NOTE FOR LEGAL REVIEW: we recommend having the application of Section 1837(j) to this service assessed by an attorney; alternatively, the 14-day period may be preserved contractually.]
10.3. Cancellation by the Provider: If the Provider is unable to provide the Service for reasons on its side (e.g. malfunction or unavailability of the Equipment with no possibility of replacement), it shall notify the Customer without undue delay and refund all payments made, including the reservation fee, within 14 days. Beyond this, the Provider is not liable for such cancellation, unless it caused the damage intentionally or through gross negligence.
10.4. Force majeure: Neither party is liable for delay or impossibility of performance caused by an extraordinary, unforeseeable and insurmountable obstacle (natural disaster, prohibition of events by the authorities, etc.). In such a case, the parties will attempt to agree on an alternative date; if no agreement is possible, the Provider will refund the payments made, less reasonably incurred costs.
11. Complaints (Rights Arising from Defective Performance)
11.1. The Customer is entitled to claim defects of the Service — in particular non-functionality of the Equipment at handover, failure to deliver the footage within the agreed period, or defects in the paid editing — without undue delay after discovering the defect, by e-mail to hello@svatebnikamery.cz.
11.2. The Provider will settle the complaint without undue delay and, in the case of a consumer, no later than 30 days after it is raised, unless a longer period is agreed. The Provider will issue the Customer with a confirmation of the settlement.
11.3. If a fault in the Equipment occurs during the wedding day, the Customer shall immediately contact the Provider at +420 739 971 763. The Provider will, to the extent possible, provide remote support or an alternative solution; if a replacement is objectively not possible in the given time, the Customer is entitled to a reasonable discount on the price corresponding to the non-functional part of the performance.
11.4. The Provider's liability for harm is limited to an amount corresponding to the price of the ordered Service; this does not apply to harm caused intentionally or through gross negligence, or to harm to a person's natural rights. In particular, the Provider is not liable for non-material harm consisting in the sentimental value of unrecorded moments.
12. Personal Data Protection
12.1. The Provider processes the Customer's personal data in accordance with Regulation (EU) 2016/679 (GDPR). Detailed information is provided in the Privacy Policy available at https://svatebnikamery.cz/ochrana-osobnich-udaju.
12.2. With respect to the content of the footage (likenesses of wedding guests), the Provider acts as a processor acting on the Customer's instructions; it processes the footage exclusively for the purpose of its technical processing and delivery, and deletes it after the expiry of the period under Article 9.2.
13. Out-of-Court Dispute Resolution
13.1. A Customer who is a consumer has the right to out-of-court resolution of a consumer dispute. The competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 796/44, 110 00 Praha 1, https://adr.coi.cz. Disputes may also be resolved via the European online dispute resolution platform at https://ec.europa.eu/consumers/odr.
14. Final Provisions
14.1. The Provider is entitled to amend these Terms to a reasonable extent; contracts already concluded are governed by the version of the Terms effective at the time of their conclusion.
14.2. If any provision of these Terms is or becomes invalid or ineffective, this shall not affect the validity of the remaining provisions.
14.3. These Terms take effect on 1 September 2026.
